EDIT: I was reading the full rules, and it probably has to be live-action. If you win, you get to go to be in a real Arby's commercial, and LEGO men probably wouldn't work.

I read those rules, and it doesn't say the entry has to be live action. The submitter of the video gets to star in a official live action commercial. It doesn't say that the submitter has to be in the video sent in. It says groups are allowed, which I think is what made you think it has to be live action. A group can produce an animated film, you know. It never specifes the medium of film. I would suppose that since they don't specify a medium of film, any medium will be accepted. Animation is a medium of film.

Not literally dead, just no longer interested in Lego or animation.

It says it cannot contain 3rd party copyrighted material so that might include legos...

LEGO minifigs, etc. are not copyrighted strictly speaking, they're trademarked designs.  Specific characters can be copyrighted and mostly are.

It does look though like the contest is based around making a concept commercial that would then be recreated professionally in live action.  Similar contests have been held by other companies before.
