Hey all,
Were all filmmakers here. Well, most of us are. I hope this thread doesn't become troublesome or I hope I'm not causing any problems by posting here but I thought this was an issue that is a must that needs to be brought up because our hobbies and what we enjoy doing maybe effected from what is about to happen. The United States congress is planning to pass a bill S. 978 that will make it a felony to stream ANY video that has copyrighted content. If a person (a youtube uploader for example) were to upload a video with copyrighted content more than ten time they can do up to 5 years in prison. Most you probably have had this issue with youtube where your video(s) was removed or at least the audio because it had copyrighted content in it. This bill will put an end to video game videos, tutorials,  etc. and even if it was a can did video of you and your friends singing. It will all become illegal and can land you in prison. So as both a filmmaker and a US citizen, I urge all other people on this forum who are US citizen to sign the petition or send a letter to your congressman or congresswoman. Don't let them ruin the youtube community!

Look, this bill doesn't stand a snowball's chance in hell. Technically speaking, this bill is a violation of the First Amendment's first clause: "freedom of expression". The PATRIOT Act has nothing on this.

The problem becomes: where do we draw the line between "copyright violation", and "fair use"? It's all highly subjective to each person's own threshold, and for me, a law with such ambiguity on enforcement shouldn't even be considered by a legislative body (Also explains why I'm opposed to the immigration laws in Arizona, Georgia, Alabama, etc.). If the threshold is low enough, corporations like CNN, NBC, UMG, and all those with material subject to copyright laws won't be able to upload their own !@#$, which would be pretty &^%$#@! hilarious! And in the brief <5 minutes that a video is on the net, people WILL watch it. That'll be one hell of a job tracking down all the IP addresses that pinged the video, especially if the address is from a public place (i.e. a library) or a proxy (for me, streaming is both uploading and downloading). Our prison system here in the United States simply won't be able to handle that kind of load.

The other problem is how broad the bill is. ANY copyright material could land you in prison, even if it's only remotely related to copyrighted material. Brickfilms use LEGO as their primary medium, which is a highly copyrighted product. If Capitol Hill gets their way, then our very hobby could be at stake.

This bill will only promote the use of P2P file sharing BitTorrent protocal programs like Limewire or Frostwire, which is kinda the opposite of what the industries that would be lobbying for this bill want: more bootlegged content in a place that's even harder to regulate. And seeing as how the law only applies to STREAMING video, an underground network of other media, like VHS/Beta tapes or DVDs, will spring up.

And what about material that can ONLY be found on YouTube? Case in point, the last 24 episodes of Animaniacs have never been released onto a DVD by Warner Bros., and since Animaniacs hasn't aired on TV since at least 2003, there goes 24 episodes of one of my favorite TV shows that I can't find anywhere else...

This bill is bullcrap. Absolute bullcrap. I want to know which congressman introduced this bill so I can hit them with my digital mallet!

For brickfilmers it would be bad news but lets face it pirating is now booming more than ever and something needs to be done about it. Besides I have stopped using copyrighted content years ago. There's a whole bunch of royalty free music websites like Jamendo.com which has sweet music and can be used for your projects.
Take a look at youtube.com it's full of movie soundtracks and other music which can be easily downloaded for free now tell me is that a good thing? Cause I don't think so.

It's not the end, even if this is passed and heavily reinforced.
For example, my upcoming movie has no copy righted stuff in it. Zero. Unless you count the fact that I'll copyright it myself, so I'll own the video, story, voices, sounds, characters and the rest.
You don't need to have you videos be filled with copyrighted stuff. mini/tongue
It's okay every once and a while, but it's kinda nice to have some originality.

Only if they use copyrighted material, and the damages exceed the amount of money stated in the bill.

If this really does go out, I wouldn't be in much danger.
Incopetech (that's where I get my YouTube music) is not copyrighted not Flashkit (where I get my sound effects)

Yeah. I know that. That would be a problem if this was real. YouTube has seen brick films on YouTube for a long time. They are not going to take them off YouTube now

At present, the bill reads:

‘(A) the offense consists of 10 or more public performances by electronic means, during any 180-day period, of 1 or more copyrighted works;

by that statement, I'm not sure the use of a product design that is copyrighted and manufactured by the copyright holder would fall under copyrighted works. It's pertinent to remember that LEGO has always had the ability to push lawsuits against brickfilmers (see Rick and Steve: The Happiest Gay Couple in All the World).

I'm not sure anyone could do that and still make some good stuff.

Woah, hold your ponies there, it doesn't say you have to make 10 films- there just have to be "10 or more public performances". It's entirely possible that by their standards, that means if more than 10 people watch one film, you are liable. I expect once the bill goes through the rounds (provided it passes), the language will become more specific and clarify this point- at present, this turn of phrase is a big reason why a lot of people are worried.
