Topic: Copyrights on LEGO?

Hey, thanks for clicking on the topic.

I´ve though about something about copyrigthing.
we all know that it´s illegal to use copyrigthed Music in your Brick Films.
But shouldn´t it also be illegal to use LEGO for your videos?

Youtube Partners get paid for their videos.
Well, then they are getting paid for a Production thing. shouldn´t THAT be Illigal? i have no problems with it, but i can´t get it out of my head...

now, i need some answers for what you guys think.
cause, my next video is for a Contest about the Invirement.
and i believe that my video is gonna be banned, cause i used something that i don´t 100% own.

but, what do YOU guys think?

Technically, we are promoting the use and creativity of using LEGOs through thousands of brickfilms that are released every month. We're not depromoting LEGOs, you don't see anyone burning LEGOs or using them in ways that they weren't meant to be used. LEGO even hosts brickfilming competitions every so often, so don't worry.

Actually, a lot of people burn minifigures to get a good effect.

for effects for the movie they are posting... You don't see a whole community of brickfilmers gathering in the releases thread discussing newest techniques of blowing up minifigs with TinyBoom, "The smallest dynamite you'll ever see! Perfect for blowing up minifigs!" products or anything. mini/lol

lol my parrents sayd the same thing about the Lego Logo.
yes, you use the product, but...   ...yeah, i dont have anytthing else to say about that.

in the contest, one of the other videos has a Carrot in it.
so i guess God should sue them, or something.. mini/smile

You have to split up your signature into a bunch of other pictures, and make the image that yo want a link. If you don't get what I'm saying, highlight DerTarchin's sig to find out.

Legally unauthorized use of a product in a project that you're making a revenue off of isn't allowed, even if you are promoting it. The use of LEGO in YouTube videos is fine as long as you don't use their logo or in some cases the word LEGO on the bricks themselves. The main reason you can do this is because they are a ton of other companies that sell plastic building blocks that for the most part look about the same.

However ever a while back on BF.com there was a legal issue when a member was trying to sell a DVD of a brickfilm that he did, and because it was unauthorized by the LEGO Company he was not a loud to gain revenue, he could distribute the DVD but not for money. This type of thing is different depending on the distributive media type.

Granted I'm not a lawyer so I don't know every detail about this.
You're completely fine gaining partnership revenue from brickfilms.

If you think about it, you're being paid for your creativity.  It's the delicate legal process of not stepping on a major corporation's toes that is the problem.

And there was that Heroes and Villians DVD that was on sell.  Not sure if that's what you're referring to.

Also, I think it is just the LEGO name and logo you can't use. The logo on the studs can't be seen, and the logo can't be used. Quite a few brickfilmers are partners, and the YouTube moderators don't seem to mind that we use it.

Sorry about the spelling. I just finished my first day back at school and can barely stay awake enough to type.

I saw the Heros and Villains DVD, but a single member was once trying to sell a DVD of a film he did. When he e-mailed LEGO about it, they told him he could not gain revenue from it. But now that I think about it, I think the reason they weren't allowing him to sell it was because they didn't want to be affiliated or be the true head in the chopping block, I think it contained some things that were too mature for the age that most LEGO users are (being the young child). And LEGO thought they might be targeted for allowing the use a violence or language or whatever the issue was.

I'll try to scourer the archived forum for the original topic, as I may have many points wrong, being that it has been years since I saw it.

I think for personal distribution for profit is not allowed.  With HaV, it was to cover for the website.  Essentially, without an agreement between distributor and manufacturer on how the money is handled, a person cannot sell his "LEGO" DVDs unless it's for nonprofit.

If you think about it, you don't own the light from the sun.  If you're shooting in a forest, you don't own the trees.  People shoot in public, they don't own the buildings in the background nor the spitwads on the floor.  You should ask the contest organizers about this issue involving plastic construction toys because no matter what we tell you here, the organizers ultimately decide.

See it this way JWKStudios, when you buy the product, you can use it however you want. Lego isn't going to break down your door and kill you for using their product to make money.
